Occupy Wall Street protesters seek to block Twitter subpoena

3 hrs.

NEW YORK -- An Occupy Wall Street protester who took part in a mass protest in New York last year is accusing a judge of overstepping his authority by ordering Twitter to hand over the demonstrator's tweets and account information to prosecutors.

Malcolm Harris, a Brooklyn-based writer, filed a civil proceeding on Monday seeking to block the judge's ruling.

Harris was arrested during a protest on the Brooklyn Bridge last October and charged with disorderly conduct in a case that is one of a handful in which authorities have sought to use social media to prosecute defendants.

Criminal Court Judge Matthew Sciarrino has rebuffed separate attempts by Harris and Twitter to quash a subpoena served on the company by the Manhattan district attorney's office seeking Harris' tweets for September to December.

Harris claims the information sought by prosecutors is akin to surveillance records, because computer logs will show his location when he connected to the site.

"In this case, anyone reviewing the information and material Twitter has been ordered to turn over will know each time - between September 15 and December 30, 2011 -- Harris logged into his Twitter account, where he was when he logged in, how long he remained there and both what he did and who he communicated with while he was logged in," Harris' lawyers wrote in a memorandum accompanying the petition.

Prosecutors from the Manhattan district attorney's office have said in court papers that Harris' tweets could demonstrate he knew police had ordered protesters not to walk onto the bridge roadway.

Harris' lawyer, Martin Stolar of the National Lawyers Guild, and other lawyers for the arrested protesters have said police appeared to lead the march onto the roadway before suddenly arresting hundreds of them.

Sciarrino ruled in April that Harris did not have the standing to challenge the subpoena, since Twitter owned his tweets. In June, he rejected Twitter's argument that turning over the tweets violated Harris' privacy and free speech rights, saying the tweets were publicly posted without any expectation of privacy.

Twitter has filed a separate notice of appeal, though it has not yet submitted its formal brief.

Criminal defendants typically are required to wait until the end of criminal proceedings before filing appeals. But Stolar said Sciarrino's ruling threatened Harris' privacy and required an immediate response.

Harris' filing also seeks an order requiring Sciarrino to recognize his standing to challenge the subpoena on free speech grounds and the Fourth Amendment's protection against warrantless searches.

The Manhattan district attorney's office declined to comment on the filing.

Guest Post ? How Different Exercises Can Improve Your Health - Blog

Hello everyone, and happy Tuesday!

I was recently contacted about featuring a guest post on my blog. I jumped at the chance for someone else to be featured on here! So today I am featuring an article written by?Jim Rollince. He works for Gym Source, as the Head of the Creative Writing Department. Enjoy! :)

How Different Exercises Can Improve Your Health

Most people know that regular exercise plays a critical role in sustaining and improving personal health. However, people often just hear advice about getting more exercise without knowing what they should do and how exactly it can help solve their health issues. This is not good at motivating people to start exercising and continue to exercise.

There are actually several different types of exercise that everyone should include in some amount in their exercise regimen. Each has a specific impact on physical and mental health.

Strength Building Exercises

Aerobic exercises used to be all the rage. They are still very important parts of any exercise regimen, however, researchers have determined that it is actually strength building exercises, such as old-fashioned weightlifting, that burn more calories and promote health more effectively. This has brought about a transition in exercise circles as people now try to balance their workouts with strength and resistance training.

Examples of strength building include the already-mentioned weightlifting exercises. However, they also include innovative approaches that use resistance to mimic weight. A lot of home gym equipment uses resistance to help buyers build strong muscles rather than riskier free weights, which are heavier, costlier and sometimes cause injury.

Many isometric exercises are also effective at strength building. Pushups and pull-ups are good examples. For an all-around experience, try squat thrusts to build strength in numerous muscles and get your pulse racing.

Aerobic Exercises

Also known as cardio workouts in some circles, these sorts of exercises are meant to put certain muscles to the test, such as those in your legs. Most important, however, is the heart muscle. High intensity workouts that involve a lot of movement rather than weights get your heart pumping fast. Doctors recommend that all people experience some sort of vigorous exercise a few times a week in order to exercise the heart and strengthen the entire cardiovascular system. This is a good way to fend off cardiovascular disease and improve your longevity.

Examples of useful exercises that bring about this temporary cardio strain are running, bicycling, swimming and aerobic dance. You can also perform these exercises indoors on treadmills or ellipticals. The exact form of exercise does not matter as much as the duration and the intensity. As long as you are getting your heart racing for periods of more than 20 minutes as much as three times a week, you are providing excellent exercise for your heart and blood vessels.

Mobility Exercises

Many people begin an exercise regimen and think of stretching as something to simply get out of the way. In fact, stretching is just as important as the rest of the exercises that you will do in a workout. Increasingly, experts suggest that just as much time be devoted to targeted and efficient forms of stretching prior to and after a workout. Good stretches increase the mobility of your joints, strengthen them and protect them. In the end, these types of exercises also protect you because they prevent you from getting hurt or damaging your joints, making it difficult if not impossible to continue exercising.

?

There are psychological benefits to all forms of exercise as well. When encouraged to exercise, most people who have previously suffered from depression or mood disorder s report an improvement in their outlook. Whatever you choose to do to workout, make sure you do it! The vast benefits of exercise are too great to be ignored.

Pakistan police arrest Christian girl under pressure from neighbours in alleged blasphemy case

ISLAMABAD - Pakistani authorities arrested a Christian girl and are investigating whether she violated the country's strict blasphemy laws after furious neighbours surrounded her house and demanded police take action, a police officer said Monday.

The arrest of the girl and outrage among the local community demonstrates the deep emotion that suspected blasphemy cases can evoke in this conservative Muslim country, where rising extremism often means religious minorities live in fear of persecution.

In Pakistan, anyone found guilty of insulting Islam's Prophet Muhammad, or holy book, the Qur?an, can be sentenced to death, although they're rarely if ever executed.

A Pakistani police officer, Zabi Ullah, said Monday that the girl was arrested Thursday after hundreds of neighbours, angry over reports she had allegedly burned religious papers, gathered outside her house in a poor outlying district of the capital, Islamabad.

He said the police took the girl to the police station, and that she's been held for 14 days while authorities investigate.

"About 500-600 people had gathered outside her house in Islamabad, and they were very emotional, angry and they might have harmed her if we had not quickly reacted," he said.

"Some Muslims from the area claim the girl had burned pages of the Qur?an, and we are investigating, and we have not reached any conclusion," he said.

Another police official, Qasim Niazi, said when the girl was brought to the police station she had a shopping bag that contained various religious and Arabic-language papers that had been partly burned but no Qur?an.

Another police officer said the matter would likely be dropped once the investigation is completed and the atmosphere is defused, saying there was "nothing much to the case." He did not want to be identified due to the sensitivity of the case.

There were varying reports on the girl's age and whether she was mentally handicapped. Ullah said she was 16 while other officials have said she was either 12 or 11. Niazi said that when the girl was brought to the police station she was scared and unable to speak normally, but he did not know whether she was mentally handicapped.

Christians often live in fear that they will be accused of blasphemy, and many critics say the legislation is sometimes used to settle scores.

Angry mobs have been known to sometimes take the law into their own hands and beat or kill people who are accused of violating the blasphemy laws. In July, thousands of people dragged a Pakistani man accused of desecrating the Qur?an from a police station in the central Pakistani city of Bahawalpur, beat him to death and then set his body on fire.

Attempts to revoke or alter the blasphemy laws have been met with violent opposition, however.

Last year, two prominent Pakistani political figures who spoke out against the laws were killed, in attacks that raised concerns about the rise of religious extremism in Pakistan.

Liberal politician Salman Taseer was shot and killed by one of his own guards in January 2011, and in March 2011, militants gunned down Shahbaz Bhatti, the only Christian minister in Pakistan's Cabinet.

A spokesperson for Pakistani President Asif Ali Zardari, Farhatullah Babar, said the president has taken "serious note" of reports of the girl's arrest and has asked the Interior Ministry to look into the case.

Creating a Master Validation Plan by Sami
Author: Clifton Castelloe Article Tools: The right wedding entertainment can truly make or break the most important day of your life. It is as essential as the venue, abercrombie et Fitch, the caterer, the photographer, the cake, the dress? And it is one of the main things that your guests will remember about your wedding day. Was the music great, or did it send everyone running for their cars before the cake cutting? Did the deejay show up an hour late in a t-shirt and jeans? Was he blasting uncensored rap lyrics and dirty dancing with his intoxicated roadies / friends (not on the guest list)? Was the band out of tune, too loud and bickering in between mediocre versions of ?Celebration? and ?Unforgettable?? Before you start sinking behind your fiance in embarrassment, here are some important questions to ensure that your wedding entertainment is first rate, and that your guests will be saying exactly what you want to hear: ?Your reception was so much fun! The music was perfect! It could not have been better.?

What is your budget?
With so much hinging on the quality of the music, it is important to look at your entire wedding budget and weigh the cost of the music in relation to other expenses. In level of importance, the music is right up there with the other crucial elements of your big day. Trying to cut costs here can be a big mistake. Many part-time bands and DJ?s can be very cheap (under $1000), but why would you choose to pay $2500 to rent an outdoor tent and then put an obnoxious DJ,Abercrombie Femme, or amateur live band right in the center of it. The wrong entertainment can be as effective as a rainstorm in making your guests scatter. Consider spending as much on entertainment as you would on anything else that you are paying for on your wedding day. In general, you will pay less for a DJ than you will for a quality live band, and any band that is the same price as the most expensive DJ in your town, is probably not very good.

How do you find the best entertainers?
An internet search for wedding entertainment, disc jockeys, or wedding musicians for hire in your area can be a good start. Any professional wedding band or DJ will have a website that includes a list of services, their song list, audio samples, photos, and testimonials from previous clients. Upon initial contact, they should be able to provide concrete references including brides, venues, and event planners they have worked with in the past. Your wedding planner or venue may also be able to provide names of good quality entertainers AND the bands or DJs that you should be sure to avoid. An entertainment booking agency is another resource that can be helpful in determining the best fit, though you should always get a second opinion (booking agents are salespeople, and they want to sell you on the acts they represent, whether the group is a perfect fit for you or not). Don?t just take their word for it, do some online research and ask your event planner and reception venues in the area if they have heard of the group,Ralph Lauren homme, or have seen them in person.

What about a contract?
Any quality entertainer will present you with a contract to solidify the booking. Often a deposit will be required in advance to reserve the date. The contract will include the name of the individual (or group) you are dealing with, as well as details of the event (location, arrival/setup time, start and end times), and cost. It may also include the band?s technical requirements, meals and lodging,Louboutin, and a request for an alternate location to be provided in the case of inclement weather (for outdoor events). This contract represents a legal bond between you and the group and should protect you in the event that the band does not show or if something goes wrong.

What is included?
When you purchase services from a live band or DJ, this should include:

* Live entertainment or DJ service for a specific time period with the option of extending the time on the day of the event if needed.

* All sound equipment (and lighting ? if required).

* MC (Master of Ceremonies) service. Some emcees are better than others and you should speak specifically about what announcements you would like to have made: this could help prevent an over-zealous DJ from trying to force the party in a direction you do not want it to go. Most professional wedding bands will include emcee service at your request (introducing the wedding party and working with your event planner to assist with the flow of the evening).

* A microphone for announcements and toasts

* Travel expenses

Who do you recommend?
Excellent wedding entertainment is out there and not too hard to find. A little research (from more than one source) can go along long way towards making your wedding day even more special AND most importantly, towards preventing any disasters! Remember that prices vary, and the best price is not always the best deal. The safest bet is a regionally known band or DJ who specializes in performing for weddings and can provide concrete evidence of a track record. The cost of the group will often be in direct correlation to two factors: First, the number of people in the group (a ten piece band tends to be more expensive than a trio) and their level of demand.
