Zimmerman makes new appeal for bail; judge considers

Circuit Court Judge Kenneth Lester is apparently weighing whether to grant bail to George Zimmerman after Friday's hearing. NBC's Kerry Sanders reports.

A bail hearing in Sanford, Fla. for George Zimmerman concluded Friday after a heated exchange in which prosecutors argued for denying bond and the defense called on the judge to reinstate the defendant's?$150,000 bail, which was revoked in early June.

Circuit Court Judge Kenneth Lester was weighing the arguments and will issue his ruling by written order, a public information officer for the Seminole County court said. The spokesman did not offer the timing of that order.

Zimmerman, charged with second-degree murder in the February shooting death of 17-year-old Trayvon Martin, is seeking release on bail for the second time. His initial bail of $150,000 was revoked and he was rearrested on June 3, after prosecutors argued that Zimmerman, with the aid of his wife's testimony, had misled the court about?their financial picture in the first bail hearing on April 20.

Zimmerman has pleaded not guilty to the?murder charge, and asserted that he acted in self-defense.

Earlier in the three-hour proceedings, ????Zimmerman's father, Robert John Zimmerman, took the stand briefly.


After the elder Zimmerman was sworn in, defense attorney Mark O'Mara played a witness 911 tape that captured the sounds of screaming and a shot being fired during the fatal encounter between Trayvon and Zimmerman.

Under questioning by O'Mara, the elder Zimmerman said he told state investigators that the voice of the man screaming "was absolutely George's."

Assistant State Attorney Bernie de la Rionda then questioned Robert Zimmerman, asking how his son could make those screaming noises if, ?as George Zimmerman told police, Martin was covering his nose and mouth.

Robert Zimmerman responded: "From the look of my son's injuries, Trayvon Martin's hands were not just on his nose and mouth."

The court heard testimony from firefighter Kevin O'Rourke, of the Sanford Fire Department, who was called to the scene after the shooting.?O'Rourke, who said he attended to Zimmerman, answered questions about the severity of the shooter's injuries.

"I observed that he had blood on his face and the back of his head," O'Rourke said.

He said that Zimmerman's nose was "obviously deformed," agreeing with defense attorney Don West that the injury was consistent with a broken nose. But under questioning by prosecutor de la Rionda, O'Rourke said he didn't diagnose Zimmerman with a broken nose.

The court was also shown the last minutes of a video taken by Sanford police on Feb. 27 in which Zimmerman discusses wounds to his nose and head.

Zimmerman appeared at the hearing wearing a grey suit, after?O'Mara had successfully argued that showing up in prison garb and shackles could damage his client's chances of getting a fair trial.

Martin's older brother Jahvaris Martin attended the hearing, along with Trayvon's parents, Tracy Martin and Sybrina Fulton. The family was escorted -- and sat with -- family attorney Benjamin Crump.

Following the money
At the start of the hearing, the first witness to testify, at the request of Zimmerman's defense attorney Mark O'Mara, was an accounting expert Adam MaGill, who detailed a series of money transfers conducted by the defendant's wife, using money contributed for his legal defense.

MaGill, who was called by the defense, said he was asked by O'Mara to look at records of money transfers from Zimmerman's PayPal account to the official legal defense fund later established by O'Mara.

The judge determined that Zimmerman and his wife Shellie misled the court about their finances his first bail hearing.

Shellie Zimmerman?testified at that April 20 proceeding that she did not know how much money was in a PayPal account set up for contributions to her husband's legal defense.

In recorded telephone conversations from jail prior to that date, Zimmerman and his wife appear to discuss ? in thinly?disguised code ? the amount of money in the account, and he instructs her to make a series of transfers to other accounts, the prosecution charges. (Read original report.)

Special Prosecutor Angela Corey used the recordings to persuade?the judge to revoke the original bond for George Zimmerman.?Shellie Zimmerman was arrested on June 12, charged with perjury and released on $1,000 bond.

She was not present at Friday's bond hearing for her husband.

O?Mara told NBC on Thursday that if Zimmerman is released on bond, he would go back into hiding for his own safety. The shooting death of Martin, an unarmed black teenager, in February has stirred an emotional national debate about race, gun rights and "stand your ground" laws like the one in Florida that use a broad definition of self-defense.

Date of earliest animal life reset by 30 million years

ScienceDaily (June 28, 2012) ? University of Alberta researchers have uncovered physical proof that animals existed 585 million years ago -- 30 million years earlier than previous records show.

The discovery was made by U of A geologists Ernesto Pecoits and Natalie Aubet in Uruguay. They found fossilized tracks a centimeter-long, slug-like animal left behind 585 million years ago in silty, shallow-water sediment.

A team of U of A researchers determined that the tracks were made by a primitive animal called a bilaterian, which is distinguished from other non-animal, simple life forms by its symmetry -- its top side is distinguishable from its bottom side -- and a unique set of "footprints."

U of A paleontologist Murray Gingras says fossilized tracks indicate that the soft-bodied animal's musculature enabled it to move through the sediment on the shallow ocean floor. "The pattern of movement indicates an evolutionary adaptation to search for food, which would have been organic material in the sediment," he said.

There were no fossilized remains of a bilaterian's body, just its tracks. "Generally when we find tracks of a soft-bodied animal, it means there's no trace of the body because they fossilize under different conditions," said Gingras. "It's usually just the body or just the tracks, not both."

It took more than two years for the U of A team members to satisfy themselves and a peer review panel of scientists that they had the right age for the bilaterian fossils.

U of A geochronologist Larry Heaman was among a group that returned to Uruguay to collect more fossil samples locked in a layer of sandstone. Heaman says because the depositional age of the sandstone is difficult to determine, they focused their investigation on particles of granitic rock found invading the sandstone samples.

Heaman explains that the granitic rocks were put through the university's mass spectrometry equipment, a process in which samples are bombarded by laser beams and the resulting atom- to molecule-sized particles are analyzed and dated.

Over the course of his U of A career, Heaman has taken part in a number of breakthrough research projects involving fossils. Last year he got the attention of the paleontology world when he confirmed the surprising date of a fossilized dinosaur bone found in New Mexico. Using U of A equipment, Heaman determined that the bone came from a sauropod, a plant-eating dinosaur that was alive some 700,000 years after the mass-extinction event that many believe wiped out all dinosaur life on Earth.

Heaman says the challenge in dating the bilaterian fossil makes it stand out from his other work. "This was the top research accomplishment because it has more direct relevance to the evolution of life as we know it," he said. "It was such a team effort; any one of us on our own couldn't have done this."

Before the U of A bilaterian find, the oldest sign of animal life was dated at 555 million years ago, from a find made in Russia.

Kurt Konhauser, a U of A geomicrobiologist, says the team's discovery will prompt new questions about the timing of animal evolution and the environmental conditions under which they evolved.

"This research was a huge interdisciplinary effort and shows the depth of the research capabilities here at the U of A," said Konhauser. "The challenge brought the sciences of geology, paleontology, geomicrobiology and geochronology together to nail down the age of the fossils."

Konhauser explains that in the past, research into the earliest signs of animal life would typically shift the date back by a few million years, but the U of A's finding of 30 million years is a real breakthrough.

The U of A's research team includes Ernesto Pecoits, Natalie Aubet, Kurt Konhauser, Larry Heaman, Richard Stern and Murray Gingras. The research was published June 28 in the journal Science.

runawayI?m at a point in my life, when I feel like I?m at a crossroads of self-discovery. Learning about myself as a parent, separate from a single woman edging toward the precipice of her 30s. Learning about how my past has shaped who I am today, and how I can work to overcome the limitations I thought were discrete barriers. Understanding my emotional and mental proclivities toward anxiety, caution, confusion, self-doubt, and indecision more and more. I tend to overthink and constantly search for the root of discovery in many aspects of life, and my own shortcomings and personality are no exception to this ever-present tendency.

One of my issues that has become clearer as presented in the scope of post-divorce dating and relationships is my recurrent tendency to run away. I get overwhelmed ? by life, work, parental responsibilities, the relationship itself, or the sheer compounded intensity of all of these facets of my life mashed together in what feels like chaos at times. Sometimes it happens early in the encounters; sometimes it?s postponed until the dopamine high of early attraction is worn off and my delicate balance of a busy single mom life falls outside the perfect compartmentalization formula for success. The recurring pattern though is that it *always* happens at some point.

And it?s not a new concept in my life. I can remember getting that feeling even as a young girl, and especially cognizant of it as my life began to become exponentially stressful in high school and college as the demands of jobs, academic success, and the other things that go along with being a young female heading toward adulthood pushed forcefully upon my shoulders.? One particular example that now stands out in my mind occurred in college; I was a co-chair for our spring formal dance, and things were frenzied with preparations on top of actually getting myself ready to enjoy the dance. ?Stressed? is probably a gross understatement of my state of being that particular day. And after I ended up with a capital-H-Horrid hairstyle that I paid a hefty bit of my menial poor college funds for, I pretty much just gave up.? I was in such a foul mood, tired, overwhelmed, and wanted nothing more than to just SKIP THE DANCE. And I did. I decided at the last minute to just not go at all. My friends gave me massive amounts of heckling for it, and no one seemed to understand how my hair could really be ?that bad.?? I didn?t even know how to explain it at the time. But now I know more about how I ?work.? The more things build and add pressure and stress and any other combination of negative emotions, the greater my impulse to just drop and RUN. It?s a rather simple formula when I step back and examine it from a purely basic perspective.

So now I notice myself thinking about ?running? at times in various contexts. At work. In social situations. And especially, the easiest to spot ? in relationships. The word that always comes to mind is ?overwhelmed? --- if I end up in a space, in any context, where I start to feel that way, my intrinsic instincts kick in, commonly thought of as the fight-or-flight response? and if the feeling sticks around, I head for the hills and change direction nearly every time.

However, it doesn?t mean that I?m flaky, or not driven. In fact, I?m usually the opposite. I have a successful academic background and stellar career path to date. I always pushed myself to the edge of my means to attempt to achieve the best that I could. There?s a perfectionistic tendency in my psyche that is difficult to ignore. I graduated college with a perfect 4.0; there was a running joke that I was a ?slave to the 4? because I was always focused on studying and schoolwork more than the average student.? I?ve steadily worked at least one regular job since I was 13 years old, and at times, held down up to 3 while simultaneously enslaved to my collegiate GPA.? But the relative barrier is there too? I was often intimidated in signing up for programs or courses that I feared were too challenging. I?d rather take on things that I felt confident that I could conquer. Something that was an unknown or seemed too challenging sent me into an anxious frenzy just thinking about it, and I politely declined any invitation to participate, where possible.

But while it?s great that through therapy and the wisdom that age and introspection brings I have begun to get a head start on understanding my typical proclivities and reactions in certain situations, relationships are dynamic, complex things, and it?s not as simple as missing a fancy dance when I get that familiar itch to bail.? How much should I trust my own instincts? Is the fear there for a reason? Or am I simply tying on my running shoes because I?m a girl with a troubled past, who assumes she can?t even trust her own judgment??

Putin?s First Stop in Israel at New Red Army Memorial, Syria and Iran Come After (PHOTOS)Zachary Lichaa

A historic memorial dedicated to the Red Army?s victory over Nazi forces during World War II will open next week in Netanya, Israel.

The monument is believed to be the first memorial dedicated to the Red Army?s victory over German forces during the second world war, outside of former Soviet Union states, and is the official basis for Russian President Vladimir Putin?s state visit to Israel next week.

A number of Russian billionaires, including Mikhail Fridman, Boris Mints, and German Khan, donated $600,000 to create the memorial, in conjunction withefforts made by the Russian Jewish Congress, the World Forum on Russian Jewry, and United Israel Appeal.

Israeli President Shimon Peres will join Putin and Yury Kanner, who heads the RJC, along with other state officials from both nations and Jewish leaders from around the globe, to mark the memorial?s opening in Netanya on June 25.

In an interview with the Washington Post this week, Israel?s Defense Minister Ehud Barak stated that if Russia and the United States worked together to combat Assad?s crackdown of the Syrian opposition, a viable solution to the conflict could be reached.

If ?America and Russia talk[ed] together about who can use what leverage, that could be extremely effective? It?s time for the world to dictate to Mr. Assad to move out of power or else. But the ?or else? can be convincing only if America and Russia will join hands,? Barak told the paper.

Putin?s last visit to Israel occurred in 2005, marking the first time a Russian president stepped foot on Israeli soil.

Fed message: Economy unlikely to improve this year

WASHINGTON (AP) ? The economy we've got today is more or less the economy we've got for the rest of the year.

That's the message from the Federal Reserve, which has sharply reduced its forecast for U.S. growth. It sees unemployment barely budging in the rest of 2012.

The Fed also says the economy is under threat from Europe's debt crisis and from the prospect of sharp spending cuts and tax increases that will kick in at year's end unless Congress acts.

None of which is comforting for companies, job seekers or President Barack Obama, whose re-election hinges in part on whether the economy improves between now and November.

Until recently, many economists were hopeful that the economy would strengthen in the second half of the year. But optimism is fading as hiring and growth have slowed for a third straight spring.

To prod businesses and consumers to borrow and spend more, the Fed said at the end of a two-day policy meeting Wednesday that it would extend a program designed to drive down long-term interest rates. It also reiterated plans to keep short-term rates at record lows until at least late 2014. And it said it's ready to do more to jolt the economy if necessary.

"If we're not seeing a sustained improvement in the labor market, that would require additional action," Bernanke said in his quarterly news conference.

Here's how a weak economy for the rest of the year could affect some categories of Americans:

? Job seekers

People looking for work aren't expected to enjoy much better opportunities in the rest of 2012. The Fed thinks the unemployment rate will fall no lower than 8 percent by year's end. It's now 8.2 percent.

American employers have become wary of hiring. They added just 69,000 jobs in May. Since averaging a healthy 252,000 a month from December through February, job growth has slowed to a lackluster 96,000 a month. And Fed officials and other economists don't think hiring will accelerate in coming months.

? Retirees and savers

The Fed's continued plan to keep short-term rates super-low through 2014 isn't happy news for people who depend on investment income. When the Fed keeps the rates it controls at record lows, rates throughout the economy generally stay low, too. That's why money market funds are paying rates barely above zero ? well below inflation.

Anyone willing to lend money to the U.S. government over the next 10 years stands to receive about 1.6 percent interest. That's just about what the consumer inflation rate has been for the past 12 months. In exchange for buying long-term U.S. Treasurys, these investors will manage merely to run in place.

? President Barack Obama

Obama's re-election bid is getting no help from the economy ? the core issue in the presidential campaign. The president's political team has been hoping the unemployment rate would drop by Election Day well below the roughly 8 percent level where the Fed thinks it will be at year's end. With job growth slumping, the president must make the tough case that it would improve in a second Obama term.

Still, unemployment might not be quite the threat to Obama that it appears. Unemployment rates in seven of the 10 battleground states that will likely determine the election are lower than the national average. That trend could blunt Republican candidate Mitt Romney's effort to capitalize on weak job growth to defeat Obama.

? Borrowers

The one group of Americans who are big winners in the Fed's low-interest-rate campaign are borrowers. They are, that is, if they meet tightened credit standards for consumer and business loans.

The average national rate nationally on a fixed-rate 30-year mortgage is just 3.71 percent. That's scarcely above the 3.67 percent average earlier this month ? the lowest since long-term U.S. mortgages were introduced in the 1950s.

Mortgage rates have been sinking because they tend to track the yield on the 10-year Treasury note. Anxiety about Europe's debt crisis has led many investors to buy U.S. Treasurys, which are considered ultra-safe despite their puny yields. When demand rises for Treasurys, their yields fall.

On Wednesday, the Fed said it thinks the economy will grow between 1.9 percent and 2.4 percent this year, sharply less than in its previous estimate in April. And it's roughly the annual pace at which most economists think the economy is growing now.

"All economists have shaved down their forecasts for this year," said Sung Won Sohn, an economics professor at the Martin Smith School of Business at California State University.

Sohn said his own forecast was in line with the Fed's. He said he was surprised the Fed didn't downgrade its unemployment outlook even more based on its forecast for economic growth.

Even so, "If the Fed's forecast unfolds, that would be bad news for incumbent politicians," Sohn said. "If I were President Obama, I would be worried."

Some political strategists expect the picture the Fed sketched of the economy to play into Romney's hands.

"If I'm Mitt Romney, I immediately use Bernanke's comments to make the case that what I've been saying is right: Barack Obama isn't working, the stimulus has failed and the only way to take us out of this is to make a change in the White House," said Joe Brettell, a Republican strategist.

He said Romney's message is simple: "I'm the guy who can fix the problem."

Most people think the biggest problem is unemployment. Brian Bethune, an economics professor at Gordon College in Massachusetts, said he thinks the unemployment rate will end the year at 8.1 percent or 8.2 percent.

Bethune thinks the Fed might decide by early fall that the economy needs some aggressive new step, such as another bond buying program. The Fed has completed two such programs. It bought more than $2 trillion in Treasurys and mortgage-backed securities.

If such a program were launched and helped boost the economy, it could end up benefiting job seekers and perhaps Obama's re-election chances.

"If we are still seeing these terrible employment numbers," Bethune said, "then the Fed is going to have to consider another move. The economy can't just flop along at this level."

Bethune said the problem for incumbents like Obama is that perceptions about the economy tend to freeze about six months before an election ? even if the economy improves after that.

Even so, economists note that continued declines in oil and gas prices could spur growth by giving consumers more spending power.

On Wednesday, the Fed said it will continue a program called Operation Twist through year's end. Under the program, the Fed has been selling $400 billion in short-term Treasurys since September and buying longer-term Treasurys. The Fed said it will extend Operation Twist using $267 billion in securities.

But it might not provide much benefit. Businesses and consumers who aren't borrowing now at historically low rates aren't likely to do so just because rates dipped a little more.

David Jones, chief economist at DMJ Advisors, estimates that extending Operation Twist will lower long-term rates by only about one-tenth of a percentage point.

Salt water aquariums come in many different shapes and sizes. The number of fish you?ll be able to keep is determined by the size of the tank which you buy. Fish require plenty of space to swim and oxygen to inhale and both of these mean that they need a lot of water. When deciding where to place your new tank, you must utilize a location which is close to an electrical socket and not too far from a source of water.

It is a great idea to choose a place which will tolerate a water spill just in case the aquarium breaks or leaks. Obviously this is something which you don?t want to happen but it is advisable to take precautions just in case.

Some people believe that you could buy fish bowls and use them as salt water aquariums. You can?t! Fish bowls are brutal even if you only house one fish. They contain unfiltered water that is not properly oxygenated and therefore is not a good home for any fish not to mention beautiful tropical ones.

Some people think that you mustn?t place salt water aquariums in the kitchen or family room. But it is better than leaving the fish in an area that gets few guests. Fish are sociable creatures and will welcome seeing different individuals walking around. That doesn?t mean that you ought to persuade folks to tap on the glass of the tank or worse stick their fingers in the water. Fish deserve some admiration and frightening them or contaminating their living area is not fair.

Treat your new fish with care and particular attention and they will thrive. If you think your fish are ill seek medical attention because chances are you will be right. You will start knowing them and will soon see if they are behaving out of character. This is often the first sign of sickness.

Auditors: Spain bank bailout could cost up to $78B

MADRID (AP) ? Spain's troubled banks could need as much as ?62 billion ($78.6 billion) in new capital to protect themselves from economic shocks, according to independent auditors hired by the government to assess the country's struggling financial sector, officials said Thursday.

The Spanish government will use the auditors' report as the basis for their application for a bank bailout loan from the 17 countries that use the euro. With tensions rising over the future of the eurozone, Spain is expected to submit its specific request for outside assistance no later than Monday, said Jean-Claude Juncker, who chairs meetings of zone's finance ministers.

"We invited Spain to pursue this clear and ambitious strategy, which needs to be implemented swiftly and communicated early," Juncker said after Spanish Economy Minister Luis de Guindos presented the audit results to the ministers who are members of the so-called Eurogroup.

Deputy Bank of Spain Governor Fernando Restoy noted that this worst-case scenario cited by the auditors was far below the ?100 billion ($126.7 billion) loan offered by the eurozone's finance ministers two weeks ago.

Spain's banking sector is struggling under toxic loans and assets from the collapse of the country's property market in 2008. Concerns that Spain's economy is so weak that it could not afford the cost of propping up its banks has sent its borrowing costs soaring to levels not seen since it joined the European single currency in 1999.

The worry is that Spain could soon find itself unable to finance its debts by itself and join Greece, Ireland and Portugal in seeking a rescue loan for not just the banks but the whole country.

The stakes are huge: Spain is the eurozone's fourth-largest economy and would seriously hit the bloc's finances should it need bailing out. The country is struggling through a recession with a 24.4 percent jobless rate. On top of this, government's main customers at its debt auctions are Spanish banks ? the sector now being bailed out. In a sign of how reluctant the markets are to invest in Spain, the country had to pay sharply higher interest rates to raise ?2.2 billion ($2.8 billion) in a bond auction Thursday.

The audits of Spain's lenders, carried out by consultancies Roland Berger and Oliver Wyman, covered 14 banking groups that account for 90 percent of the country's financial sector. The country will use the reports' findings to decide how big a bailout loan to ask for.

Restoy and Deputy Economy Minister Fernando Jimenez Latorre declined to outline individual banks' needs.

In the auditors' stress test for the worst-case economic scenario ? a fall in gross domestic product of 6.5 percent over the period 2012-2014 ? most of the banks were deemed to be in a "comfortable" position, Restoy said.

"We're not talking about the imperative capital necessities of the banks. We're not talking about someone urgently needing such and such an amount of capital to deal with their obligations," said Restoy. "We're talking about the capital that would be needed if we were to see a situation of extreme tension which is very unlikely to come about."

"We should keep in mind we are not talking about how much capital an entity needs to survive. We're talking about how much capital an entity will need to confront a situation of extreme stress," he added.

Eurozone finance ministers offered Spain a bailout loan of up to ?100 billion on June 9. The terms of the loan ? for which Spain, rather than banks, will ultimately be responsible for ? still have to be negotiated.

Spanish Prime Minister Mariano Rajoy hailed the audit results during a visit to Brazil as an important move toward restoring international confidence in Spain, currently seen as one of the eurozone's weakest links.

"It's a decisive step in the right direction because it makes an accurate and credible diagnosis that fences in the capital needs in manageable margins and ensures that the financial assistance made available to Spain by our European partners is more than enough to solidly clean up our financial institutions," Rajoy said in Sao Paulo after meeting with business leaders.

Oliver Wyman Inc. gave a worst-case range of ?51 billion to ?62 billion in new capital needs while Roland Berger Strategy Consultants GmbH gave a single figure of ?51 billion.

The release of the audits probably won't erase market nervousness about Spain, said Mark Miller, an analyst with Capital Economics in London.

"At face value it looks as if there is a reasonable safety margin given that up to ?100 billion is potentially available," he said. "Having said that, the extent of the economic situation in Spain could even deteriorate beyond what is being described as an adverse scenario."

Some investors will likely still be nervous over whether the auditors' reports discovered most if not all of the toxic assets on the balance sheets of Spain's banks, Miller said. And their fears are compounded by concerns that Greece might still end up having to leave the single currency, further destabilizing the eurozone and especially Spain.

The results of the audits are good news for Spain because both companies came up with similar numbers and the overall figures were lower than some estimates of the banking sector's recapitalization needs, said Gayle Allard, an economist with Madrid's IE Business School.

"I think it's a fantastic result because there was talk of needs of ?70 billion to ?80 billion and that the loan could have been for ?100 billion," she said.

Investors could still easily find something to scare them about the results, Allard said, "but I don't think there's any reason to do so."

She added: "The audits have come in better than anyone has expected, there's still some uncertainty, but if both of them are coming to the conclusion of those numbers we've got to be in the ballpark."
